Welcome to Tiny Toes Newborn Consulting LLC ("Tiny Toes," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your use of our website, tinytoesnewborn.com (the Site), and the pediatric sleep consulting services (the Services) we provide. By using the Site or booking the Services, you agree to these Terms.

1. Tiny Toes offers baby registry and sleep consulting services including customized sleep plans and virtual support as specified in your package.

2. NO MEDICAL ADVICE: Tiny Toes provides educational information only. We do not offer medical diagnosis or treatment. Consultation does not establish a medical provider-patient or nurse-patient relationship. Our advice is for healthy children with common sleep issues that are unrelated to medical conditions. The information provided is not intended nor is it implied to be  a substitute or supplement for professional medical advice. Always seek the advice of your pediatrician with any questions you may have regarding a medical condition or the health and welfare of your baby. Use of our information is at your own risk and requires your pediatrician's approval before implementation. 

3. CLIENT RESPONSIBILITIES: You agree to provide accurate child health information and maintain a safe sleep environment according to AAP guidelines.

4. BOOKING & PAYMENTS: Full payment is required at booking via our secure website.

5. CANCELLATIONS & REFUNDS: Due to the specialized nature of our consulting, all sales are final. No refunds are issued once intake forms ares submitted.

6. RESCHEDULING: You may reschedule within 24 hours' notice through the booking section of our website. 

7. RESULTS NOT GUARANTEED: Whether you benefit from the services provided depends on the individual, as every child is unique, their sleep patterns and challenges, their temperament, the various factors and the complex nature of sleep, and the commitment and consistency required. Tiny Toes Newborn Consulting LLC does not guarantee specific sleep milestones, timeframes, or outcomes. By engaging in Tiny Toes Newborn Consulting LLC services, you acknowledge that results are not guaranteed.

8. COMMUNICATIONS & PRIVACY: Your privacy is governed by our Privacy Policy. You consent to service-related communications from us at the contact information you provided. You must "opt in" to receive email communication from us. Unsubscribe anytime using the link at the bottom of the email. 

9. INTELLECTUAL PROPERTY: All materials are the sole property of Tiny Toes Newborn Consulting LLC. Content may not be reproduced, shared, or republished in any format without our express written consent.

10. LIABILITY LIMITATIONS; To the extent permitted by law, Tiny Toes Newborn Consulting LLC is not liable for incidental, indirect, punitive, or

consequential damages arising from using the Site or the Services.

11. INTELLECTUAL PROPERTY: All documents and information generated are the sole property of Tiny Toes Newborn Consulting LLC. Content may not be reproduced, shared, or republished in any format without our expressed prior written approval.

12. PERSONAL USE ONLY: All documents and information generated is intended solely for personal use and the specific needs of your child. It should not be shared or distributed to others without our prior expressed written consent.

13. RESTRICTION ON AI:  Under no circumstances should any documents or information provided by Tiny Toes Newborn Consulting LLC be uploaded to any Artificial Intelligence (AI) systems or platforms. This includes but not limited to, AI training databases or third party applications, including automated systems, AI tools, or machine learning algorithms. By utilizing the Site or the Services, you acknowledge and agree to these usage restrictions. Any unauthorized use of the information or documents provided by Tiny Toes Newborn Consulting LLC for artificial intelligence development or content generation is strictly prohibited.

14. THIRD-PARTY CONTENT: Any links to third-party products, services, or sites are subject to separate terms and conditions. Tiny Toes Newborn

Consulting LLC is not responsible for or liable for any content on or actions taken by such third-party company or website. Although Tiny Toes Newborn Consulting LLC may recommend third-party sites, products or services, it is your responsibility to fully research such third parties before entering into any transaction or relationship with them. 15. TESTIMONIALS: We may use your reviews for marketing unless you request otherwise. By submitting testimonials, reviews, comments, or other feedback ("submissions") to the website or in connection with the Services, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Submissions in any media. Although all attempts have been made to verify the information provided is accurate, Tiny Toes Newborn Consulting LLC does not assume responsibility for errors, omissions, or contrary interpretations of the subject matter within the consultation. Reliance on any advice given by Tiny Toes Newborn Consulting LLC is solely at your own risk.

17. GOVERNING LAW: These Terms are governed by the laws of North Carolina. These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any disputes arising out of or relating to the use of the Site or the Services shall be subject to the exclusive jurisdiction of the state and federal courts located in Mecklenburg County, North Carolina.
